Opinions and discussion on .... Reforming the  Real Estate Agents Act 1976

With the real estate market in buoyant mode and people increasingly buying property at auction, there has been a lot of discussion recently about practices in the real estate industry.

The Ministry of Justice is seeking the public's views  on reforming the Real Estate Agents Act 1976. The ministry says that " While occupational licensing seems to be the most appropriate form of regulation for real estate agents", they  would like to hear from you if you think a case can be made for regulating real estate agents in a different way.

If occupational licensing for real estate agents remains, there may be parts of the current licensing system that could be improved. We would therefore also like to hear your views on the effectiveness of the current system and how it might work better.

This paper is set out in three parts:

* Part A provides some background information about the real estate industry and how it is currently regulated.
* Part B asks whether you think there is a case for changing the form of occupational regulation that applies to real estate agents.
* Part C asks for your comments on how the current licensing system could be improved, assuming that occupational licensing remains.
